Terms & Conditions
These Terms & Conditions explain the rules for using the Aurelia Sun website, creating an account and purchasing products from us. Please read them carefully before placing an order.
Important information about orders, prices, delivery and consumer rights is set out below.
Payments are processed through the payment methods and providers presented during Shopify checkout.
Our customer care team can assist with product information, orders, deliveries and returns.

```2. Agreement to these Terms
```These Terms apply to visitors, account holders and customers who access or use our website or purchase products from Aurelia Sun.
By using the website or placing an order, you agree to these Terms together with our:

The version of these Terms in effect when an order is placed will apply to that order. Later changes will not retrospectively alter an accepted order unless required by law or agreed with you.
3. Eligibility and customer accounts
```You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order.
When creating an account or placing an order, you agree to provide accurate, current and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. Please notify us promptly if you believe your account has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to investigate suspected fraud, unauthorised use, unlawful activity or a material breach of these Terms.

```Aurelia Sun retails clothing, hats and accessories supplied by independent manufacturing partners.
We aim to ensure that product titles, descriptions, prices, materials, sizing details, colours, images and availability are accurate and up to date.
Product colours and appearance may vary slightly because of lighting, photography, screen settings and device displays. This does not permit a supplied product to materially differ from its published description or images.
Product measurements may vary within reasonable manufacturing tolerances. Any relevant product-specific sizing information will be shown on the product page or size guide.
Where a product page contains a specific performance, material or test claim, that claim applies only to the product identified on that page and should be read together with any stated conditions, limitations and care instructions.
5. Placing an order
```When you submit an order through our website, you are offering to purchase the selected products at the price and on the terms shown during checkout.
6. Order acceptance and cancellation
```We may decline or cancel an order before dispatch where there is a legitimate reason, including when:
- The product is unavailable or cannot be fulfilled.
- An obvious pricing or product-information error has occurred.
- Payment cannot be authorised or verified.
- The supplied delivery address is incomplete, invalid or outside the available delivery area.
- We reasonably suspect fraud, unauthorised payment or unlawful activity.
- A quantity limit or clearly published promotion condition has been exceeded.
- Accepting or fulfilling the order would breach a legal or regulatory requirement.
We will notify you when an order is declined or cancelled. If payment has already been collected, the relevant amount will be refunded to the original payment method.
We will not cancel an accepted order merely because we later decide that the agreed price was commercially unfavourable.
```7. Prices, taxes and charges
```The price charged for a product is the price displayed during checkout when the order is submitted, subject to the treatment of obvious errors described below.
Prices shown to customers shopping in the Australian market are displayed in Australian dollars unless another currency is clearly identified.
Applicable product taxes and standard charges will be disclosed before the order is submitted. Shipping costs are displayed in accordance with our Shipping Policy and during checkout.
Where import duties, customs charges or other cross-border fees may apply, this will be explained in our Shipping Policy or during checkout before purchase.
Obvious errors
Despite reasonable care, a product may occasionally be displayed with an obvious pricing or technical error. When an obvious error affects an order, we will contact you before fulfilment and offer the choice of:
- Proceeding at the correct price; or
- Cancelling the affected product for a full refund.
We will not charge a corrected price without first obtaining your agreement.

```Payment must be made using one of the payment methods displayed during checkout.
By submitting payment details, you confirm that you are authorised to use the selected payment method and that the supplied billing information is accurate.
Payment processing is provided by Shopify and the applicable third-party payment provider. Their own terms and privacy practices may also apply to the payment transaction.
We may carry out reasonable verification or fraud-prevention checks before accepting or dispatching an order.
```9. Discounts and promotions
```Discount codes and promotional offers may be subject to clearly stated:
- Start and end dates.
- Eligible products or collections.
- Minimum purchase requirements.
- Customer or usage limits.
- Geographical restrictions.
- Other material exclusions.
Unless the promotion states otherwise, discount codes cannot be applied retrospectively, exchanged for cash or combined with another discount.
We may correct, suspend or withdraw a promotion before an order is placed where there is an error, misuse or technical problem. A change will not normally remove a valid discount from an order that has already been accepted.
Any reference to a previous price, saving or limited-time offer is intended to reflect the actual promotion and applicable pricing period.
```10. Gift cards
```Gift cards are subject to any additional conditions displayed on the gift-card product page or supplied with the gift card.
Gift cards:
- Can be used only through the Aurelia Sun store.
- Cannot be redeemed for cash except where required by law.
- Must not be purchased or used fraudulently.
- May be cancelled or replaced where required by applicable law or where fraud is established.
Applicable expiry information and redemption conditions will be displayed before purchase.
```11. Product availability
```Product availability can change. We take reasonable steps to keep availability information accurate but cannot guarantee that every product shown will remain available until an order is accepted.
If a product becomes unavailable after you place an order, we will notify you and either:
- Refund the unavailable product;
- Offer an appropriate alternative for your approval; or
- Cancel and refund the affected order where fulfilment is not possible.
We will not substitute a materially different product without your agreement.
```12. Shipping and delivery
```Available delivery destinations, shipping charges, processing times and estimated delivery times are explained in our Shipping Policy and during checkout.
Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.
We will take reasonable steps to fulfil orders within the stated timeframe and communicate material delays that become known to us.
Delays may occur because of carriers, customs procedures, weather, public holidays, incorrect address information or events outside our reasonable control.
Nothing in this section removes any right that applies where products are not supplied within an agreed or reasonable period.
```13. Delivery information and failed deliveries
```You are responsible for checking that your name, delivery address, email address and telephone details are correct before submitting an order.
Contact us promptly after ordering if you identify an error. We cannot guarantee that an address can be changed after an order has entered processing or has been dispatched.
Additional costs caused by an incorrect address, refused delivery, failed delivery attempt or uncollected parcel may be charged or deducted from a refund where:
- The issue was not caused by Aurelia Sun or the carrier;
- The charge is reasonable and permitted by law; and
- The relevant cost is communicated to you.
Risk of accidental loss or damage normally passes to you when the order is delivered to you or a person authorised by you to receive it.
```14. Returns and refunds
```Change-of-mind returns, faulty products, return costs and refund processing are handled in accordance with our Returns & Refunds Policy.
Eligibility conditions applying to voluntary change-of-mind returns do not restrict remedies available for products that are faulty, unsafe, incorrectly supplied or otherwise fail to meet applicable consumer guarantees.

```Our products come with consumer guarantees that cannot legally be excluded where the Australian Consumer Law or another mandatory consumer protection law applies.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or another remedy when a product:
- Is not of acceptable quality.
- Is unsafe or defective.
- Does not match its description, sample or demonstration model.
- Is not fit for a stated or reasonably disclosed purpose.
- Is incorrectly supplied.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
16. Sizing and fit
```Size guides, measurements and fit descriptions are provided to help customers choose an appropriate size.
Sizing may differ between product styles and manufacturing partners. Please review the size information for the specific product rather than relying solely on a size previously purchased.
Contact our customer care team before ordering when you require additional sizing information.
Nothing in this section limits your rights where the supplied product is materially different from its published measurements or description.

```Please follow the care and usage instructions provided on the product label, packaging and product page.
Product appearance, fit or lifespan may be affected by normal wear, misuse, alteration, accidental damage or failure to follow reasonable care instructions.
We are not responsible for damage caused solely by improper care or misuse. This does not exclude responsibility for an existing manufacturing defect or a failure to meet an applicable consumer guarantee.

```You may use the website only for lawful personal or commercial browsing and purchasing purposes.
You must not:
- Attempt to gain unauthorised access to accounts, systems, servers or data.
- Introduce malware, malicious code or harmful technology.

- Use the website for fraud, unlawful activity or infringement of third-party rights.

Nothing in these Terms transfers ownership of intellectual property to a website user or customer.

```When submitting a review, image, comment or other content, you confirm that:
- The content reflects your genuine experience or opinion.
- The content is accurate to the best of your knowledge.
- You own the content or have permission to submit it.
- The content does not infringe another person’s rights.
- The content is not unlawful, abusive, deceptive or malicious.
You grant Aurelia Sun a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and adapt the submitted content for operating the website, customer communication and marketing, subject to applicable privacy and consumer laws.
We may moderate or remove content that is unlawful, fraudulent, unrelated, abusive, contains personal information or violates these Terms. We will not remove a genuine negative review solely because it is unfavourable.

```The website may use or link to services provided by Shopify, payment providers, delivery carriers, review platforms, social networks and other third parties.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for independent third-party content or services that are outside our control.
This does not remove any responsibility Aurelia Sun has for selecting, instructing or using service providers in connection with your order.

```We aim to keep the website available, accurate and secure. However, temporary interruptions, maintenance, technical errors or compatibility issues may occur.
We may update, maintain or temporarily restrict parts of the website where reasonably necessary for security, technical, legal or operational reasons.
We will correct material errors that become known to us as soon as reasonably practicable.
```23. Limitation of liability
```Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable consumer guarantees and liability arising from fraud or wilful misconduct.
To the extent permitted by law, Aurelia Sun is not responsible for:
- Loss that was not reasonably foreseeable when the contract was formed.
- Loss caused by inaccurate information supplied by the customer.
- Loss caused solely by misuse, unauthorised alteration or failure to follow product instructions.
- Business losses arising from a purchase made primarily for personal or household use.
- Interruptions or failures caused by events outside our reasonable control.
This section does not limit any remedy available where a product fails to meet a mandatory consumer guarantee.
```24. Events outside reasonable control
```We are not responsible for delay or failure caused by an event outside our reasonable control, including severe weather, natural disasters, industrial action, transport disruption, customs delays, government measures, network failures or widespread carrier interruption.
We will take reasonable steps to minimise the effect of the event and resume performance when reasonably possible.
Where an event causes a substantial delay or makes fulfilment impossible, we will provide an appropriate option, which may include cancellation and a refund for the unfulfilled part of the order.

```We handle personal information in accordance with our Privacy Policy.
By placing an order, you agree to receive service communications reasonably required to process, deliver and support the order.
Marketing communications are sent only in accordance with applicable consent requirements. You may unsubscribe from marketing messages using the method provided in the communication.

```We may update these Terms to reflect changes to our services, business operations, technology or legal obligations.
Updated Terms will be published on this page with a revised “Last updated” date.
Changes apply prospectively. The terms applicable to an existing order remain those in effect when the order was placed, unless a change is legally required or agreed with you.
```27. Governing law and disputes
```These Terms and contracts formed through the website are governed by the laws of the Netherlands.
This choice of law does not deprive a consumer of any mandatory protection available under the laws that apply in the consumer’s country of residence, including the Australian Consumer Law where applicable.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the issue directly.
The courts of the Netherlands have non-exclusive jurisdiction, except where mandatory consumer law permits or requires a claim to be brought in another competent jurisdiction.

```Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or limited only to the extent necessary to make it lawful where possible.
No waiver
A failure or delay in enforcing a right does not mean that the right has been waived.
Transfer
We may transfer our rights or obligations to another business as part of a genuine business transfer, restructuring or legal requirement, provided this does not materially reduce your existing rights.
You may transfer your rights under an order where the law permits or with our written agreement.
Entire agreement
These Terms, together with the policies and order information expressly incorporated into them, form the agreement between you and Aurelia Sun concerning the website and your purchase.
